PRIVACY POLICY

Last modified February 2025

PLEASE REVIEW THIS POLICY CAREFULLY
This Privacy Policy explains how Rise Talent Strategy LLC (“we,” “us,” or the “Company”) collects, uses, and protects information submitted through www.riseonbalance.com and all associated subdomains, platforms, and official Company accounts on Instagram®, LinkedIn®, YouTube®, and any future platforms (collectively, the “Sites”).

Questions regarding this Privacy Policy may be directed to the contact information listed below. This Privacy Policy works in conjunction with the Company’s Terms & Conditions, which collectively govern access to and use of the Sites. Use of the Sites constitutes consent to this Privacy Policy.

COLLECTION OF YOUR PERSONAL INFORMATION.
Unless expressly stated otherwise, the Company does not intentionally collect personally identifiable information from users of the Sites. However, when the Sites are accessed, certain technical information is automatically collected—such as IP address, domain name, browser type, access time, and referring website addresses. This information is generally used to maintain and improve the functionality, security, and performance of the Sites, and to ensure compliance with the Terms & Conditions.

Most Site features are available without requiring user registration. However, certain services—such as subscribing to email updates or downloading resources—may require submission of personal information. Users may choose not to provide this information, though doing so may limit access to specific features or content. The Company only collects information reasonably necessary to fulfill a request or to enter into a contract. Consent will not be requested for any unnecessary data processing as a condition of access.

INTERNATIONAL PRIVACY LAWS AND YOUR RIGHTS UNDER THE GDPR
Users accessing the Sites from outside the United States acknowledge that their information may be transferred to and processed in the United States, where the Company’s servers are located. Depending on the nature of the services and the information involved, user data may also be transferred to or stored in countries outside the user's country of residence. These countries may not have data protection laws as comprehensive as those in the user’s jurisdiction. However, all collection, storage, and use of personal data is governed by this Privacy Policy.

Users residing in the European Union (EU) are entitled to rights under the General Data Protection Regulation (GDPR), including the rights of access, correction, erasure, restriction of processing, data portability, and objection. Users may exercise these rights by contacting support@riseonbalance.com. The Company processes personal data based on user consent or contractual necessity.

Where consent is the legal basis for processing, users have the right to withdraw consent at any time. Such withdrawal does not affect the lawfulness of data processing carried out prior to withdrawal. Users also retain the right to lodge a complaint with the relevant data protection authority in their jurisdiction.

COOKIES: WHAT THEY ARE, AND WHY THEY ARE NEEDED.
A cookie is a data text file sent from a website to a user’s browser for the purpose of identifying the user and allowing access to portions of the website, thus alleviating the need to continually log in with a username and password. Cookies may be stored on the user’s system.

To the extent the Sites use cookies, the Sites can only access information from cookies sent by the Sites, not those from other websites. Cookies may be used to personalize visits to the Sites, as tracking usage allows for improved understanding of user preferences and the effectiveness of content or advertising.

MY POLICY WITH MINORS.
The Sites are not intended for individuals under the age of 18. The Company does not knowingly collect or maintain personal information from anyone under the age of 18, and no part of the Sites is designed to attract individuals in that age group. The Company does not offer or market products or services intended for purchase by children. If it is discovered or otherwise made known that personal information has been collected in violation of this policy, such information will be promptly deleted.

DATA RETENTION
Personal data collected through the Sites is retained only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law.
Data may be retained to comply with legal obligations, resolve disputes, or enforce contractual agreements for a period of up to 6 years, unless applicable law requires a different duration.
Once data is no longer required for these purposes, it is securely deleted or anonymized in accordance with applicable regulations.

USE OF YOUR PERSONAL INFORMATION.
If personal information is voluntarily provided, it will not be willingly shared with companies outside the organization except as described in this Privacy Policy. Users may receive communications related to products or services that may be of interest. These communications may be discontinued at any time via an opt-out link provided in each email.

Aggregated, non-personally identifiable user statistics may be disclosed to describe services to advertisers, affiliates, or other lawful parties.

Information collected may be used to better understand overall user behavior, manage and troubleshoot the Sites, process transactions, contest entries, or other user-initiated actions. It may also be used to tailor content, offers, or communications based on user preferences and to announce improvements or changes to the Sites or registration features.

Users have the right to request access to personal data by contacting support at support@riseonbalance.com. A response will be provided within 45 calendar days of receipt. In cases of delay, notice will be provided, and a reasonable extension will be communicated electronically. Identity verification may be required before processing. Responses will be delivered electronically unless otherwise requested. If any data is inaccurate or if users request the deletion of personal data (e.g., an email address submitted through an opt-in), requests may be submitted to support@riseonbalance.com. Any data no longer needed for its original purpose will be deleted.

The Company does not sell, rent, or lease users’ personally identifiable information to any merchant, advertiser, or publisher. Non-personally identifiable information (e.g., browser type, system data) may be shared with third-party business partners for analytics or contractual reasons.

Personal information may be disclosed as required to comply with legal obligations, investigations, to enforce Terms of Use, or in the context of a merger, acquisition, or asset sale.

Any personally identifiable information voluntarily disclosed in public areas of the Sites may be collected and used by third parties. The Company does not monitor or accept liability for any such disclosures.

Users are responsible for reviewing the privacy practices of third-party websites linked from the Sites. The Company is not responsible for the privacy policies, statements, or content of any external sites. Co-branded sites or content featuring the Company’s name and a third party’s name are delivered by the third party, not by the Company.

USE OF INFORMATION WITH AI
The Company takes all reasonable technical, administrative, and organizational precautions to safeguard personal data, including measures to limit access to any custom GPT or AI-enabled functionality hosted on the Sites. Where possible, the Company implements restrictions on data collection by third parties, including OpenAI, and only collects user input that is reasonably necessary for the intended interaction.

However, no internet transmission, storage method, or AI interface is completely secure or error-free. The Company cannot guarantee that OpenAI or any third-party provider will not access, store, or use information submitted through AI tools for its own purposes. Users are strongly advised not to input personal, sensitive, or identifying information—whether their own or that of others—into any GPT or AI-enabled feature on the Sites.

Users should provide only the minimum information necessary to receive desired output and understand that they do so at their own risk. Use of any GPT or AI-enabled functionality on the Sites constitutes express acknowledgment of this policy and acceptance of all associated risks. The Company will continue to review privacy laws, platform practices, and internal security measures related to AI use.

For more information on how the use of AI tools on the Sites is governed, including disclaimers and limitations of liability, please refer to the “Artificial Intelligence Disclaimer” section in our Terms & Conditions.

LIMITATIONS.
By using the Sites, users acknowledge and agree that the Company is not responsible for any disclosure of personal information voluntarily made by a user to third parties through use of the Sites; any disclosure resulting from unlawful access to Company systems or data; or any accidental disclosure of personal information by the Company, provided that reasonable security measures were in place.

POLICY CHANGES.
The Company may modify this Privacy Policy from time to time. Any modifications will become effective immediately upon being posted on the Sites. While reasonable steps may be taken to notify users of material changes, it is the user’s responsibility to review the updated Privacy Policy periodically. The “Last Updated” date at the top of this Policy indicates when changes were made. Continued use of the Sites after any modifications constitutes acceptance of the revised Policy. For reference, users may compare the current version to prior versions to determine any changes made.

YOUR COMMENTS AND CONCERNS.
The Sites are operated by Rise Talent Strategy LLC, a Delaware limited liability company. All feedback, comments, technical support requests, and other communications related to the Sites should be directed to support@riseonbalance.com.

RESULTS, RECOMMENDATIONS & AFFILIATE DISCLOSURE
The Sites may include curated resources, guest insights, personal stories, interviews, self-assessment tools, and product recommendations—some of which may contain affiliate links or sponsored partnerships. This means the Company may earn a commission if a purchase is made through these links, at no additional cost to the user.

We share only tools, services, and products we genuinely believe may benefit our audience. However, inclusion of a resource does not constitute an endorsement of claims made by third parties, nor does it substitute for medical, financial, legal, or therapeutic advice.

Outcomes shared—including testimonials, contributor experiences, and self-assessment results—reflect individual perspectives and are not typical or guaranteed. Your results may vary based on many factors, including personal decisions, background, effort, and external circumstances.

Affiliate-linked content may appear across blog posts, newsletters, podcast episodes, guest interviews, or resource toolkits. The Company complies with applicable FTC guidelines and aims to clearly disclose affiliate relationships wherever applicable.

All content is provided for informational purposes only. No professional-client relationship is created through use of the Sites, and users are solely responsible for how they interpret or act upon any information shared.

CONTRIBUTOR & COMMUNITY DISCLAIMER
The Sites may feature content created or submitted by guest contributors, collaborators, or community members—including interviews, Q&A submissions, articles, testimonials, or commentary. These contributions reflect personal opinions and lived experiences and are not reviewed for professional accuracy. They are not intended as advice or guarantees of outcome.

Users are solely responsible for any content they submit or share, including ensuring that such content does not infringe upon any copyright, trademark, or other proprietary rights of third parties. By posting, users represent and warrant that they have all necessary rights to share such content. The Company disclaims all liability for any third-party claims arising from user-submitted content.

Users may not post or submit any content that is unlawful, harmful, harassing, defamatory, abusive, discriminatory, or otherwise objectionable. The Company reserves the right to remove any content or restrict access to users at its sole discretion.

By submitting content, contributors grant the Company a royalty-free, non-exclusive, worldwide license to publish, adapt, and distribute their submissions across the Company’s platforms and communication channels. All submissions are subject to editorial review and may be modified or declined at the Company’s sole discretion.

It does not constitute medical, legal, financial, therapeutic, or other professional advice, and should not be relied upon as such. Always consult with a qualified professional before making any health, wellness, career, or legal decisions. Use of the Sites does not create any professional-client relationship.

LIMITATION OF LIABILITY & DISPUTE RESOLUTION
To the fullest extent permitted by law, the Company, its officers, employees, contractors, contributors, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses—arising from or related to your access to or use of the Sites, any content, any self-assessment tools, or any third-party resources.

All content is provided “as is,” without warranties of any kind, express or implied. Your reliance on any content shared on the Sites is at your sole discretion and risk. No guarantees are made regarding the accuracy, completeness, or outcomes of using the content or tools provided.

The Company’s total cumulative liability to any user for any claim arising out of or relating to these Terms or the user’s use of the Sites shall not exceed the greater of $500 USD or the total amount paid, if any, by the user for products or services offered by the Company during the twelve (12) months preceding the claim.

Any dispute or claim arising out of or in connection with these Terms shall be resolved by binding individual arbitration in the State of Delaware under the rules of the American Arbitration Association. Users waive any right to participate in class actions, class arbitrations, or representative proceedings.
Nothing in this section shall prevent either party from seeking equitable relief for the protection of intellectual property or unauthorized use of the Sites in a court of competent jurisdiction.

The Company may modify these Terms at any time. Updated versions will be posted on this page with a revised “Last Updated” date. Continued use of the Sites after changes are posted constitutes acceptance of the modified Terms. Users who do not agree with the updated Terms should discontinue use of the Sites.
